Obtains Summary Judgment For Airport Operator
In
September 2006, MMH obtained a Summary Judgment in favor
of its client, which operates a small airport in the
Northern reaches of the state of Florida. The accident
occurred when a small aircraft was making an approach
to the airport and resulted in two fatalities and two
injuries. The airport was accused of failing to assure
the pilot's competence prior to allowing his operations
at the airport.
Evidence presented by MMH convinced the Judge that there
was no wrongdoing on the part of the airport. As a result,
the Judge entered Judgment in favor of the airport,
thereby precluding the necessity of having a jury determine
the cases outcome.

MMH
Successfully Defends Aircraft Maintenance Facility
In
December 2005 a team of MMH attorneys successfully defended
an aircraft maintenance facility against claims arising
from the crash of an aircraft shortly after takeoff,
which resulted in three fatalities. The claims were
tried to a jury in a proceeding which lasted nearly
two weeks. Plaintiffs claim that their decedents died
as a result of the maintenance facility’s negligence
in performing work on the aircraft’s engine shortly
prior to the fatal accident.
After hearing considerable evidence in the case, the
jury returned a verdict in favor of MMH’s client
and found that there was no negligence or other wrongdoing
on the part of the maintenance facility. |
